The Social Security Fairness Act was recently signed into law on January 5th, 2025. This act represents a major change in how retirement benefits are calculated for millions of Americans. This act repeals two specific provisions: the Windfall Elimination Provision (WEP) and the Government Pension Offset (GPO). These provisions had significantly reduced Social Security benefits for many public sector employees who also received pensions from non-covered government jobs, such as law enforcement officers, teachers and firefighters.
What did the WEP and GPO do?
The WEP was meant to prevent “double-dipping” into Social Security for those individuals who also received pensions from jobs that didn’t pay into the system. Similarly, the GPO also reduced or even mitigated spousal or survivor Social Security benefits for retirees who also received a government pension.
For many years, these provisions were noted for being unfair and disproportionately affecting middle and lower-income retirees. Now that the GPO and WEP have been fully repealed, all those beneficiaries who were previously affected can expect to see benefits.
Who Benefits from the New Law
The Social Security Administration (SSA) states that approximately 3 million Americans are expected to benefit from this repeal. Some of the affected people include retired teachers, emergency service workers as well as federal workers.
Beneficiaries can expect to receive an increase in monthly Social Security payments as well as lump-sum retroactive payments to compensate for the prior reductions.
Retroactive Payments: How and When They’ll Arrive
The new legislation stated that the repeal of the WEP and GPO is retroactive to January 2024. This simply means that beneficiaries will receive a one-time lump-sum payment for the amount that they would have received from January 2024 till the point of when their new benefits kicked in.
The SSA has started issuing retroactive payments in late February 2025, primarily via direct deposit. Social Security benefits are paid one month behind. Most affected beneficiaries will begin receiving their new monthly benefit amount in April 2025 (for their March 2025 benefit). The rest, particularly those with complicated benefit calculations, may see delays due to manual processing. The SSA expects all retroactive payments to be issued by November 2025.
If you believe you qualify but haven’t yet received your retroactive benefit, the SSA advises waiting until August 2025 before contacting them, as their system is still working through the backlog of complex cases.
Monthly Benefit Increases Are Also Underway
In addition to retroactive payments, retirees are also seeing increases in the monthly benefits. The increase amount depends on how the WEP and GPO affected individuals’ benefits.

The SSA is sending out formal notices to all those recipients who are affected. These notices highlight all the changes to their benefits. It is still important to check and monitor your bank account and benefit statements closely to identify changes.
All those recipients who are unaware whether they qualify or whether they want to know how the changes will affect them, are urged to visit the official SSA website which details all information about the legislation. In addition to this, beneficiaries can visit the SSA office or use their online account to track changes.

Even though the SSA has some hurdles to overcome, the repeal of these two provisions mean that millions of public sector retirees will finally be receiving benefits.
